The Wyoming Department of Agriculture submitted their state plan requesting delegated authority for the regulation of hemp in Wyoming Thursday. The USDA will review the Wyoming plan once they have rules enacted in the fall of this year. Along with this, after an extensive legal review of all existing federal and state laws, it was determined that it is not legal to produce or process hemp in Wyoming before the USDA enacts federal regulations or Wyoming enacts hemp regulations after receiving delegated authority from the USDA. In February, the USDA stated that they will not enact rules until the fall of 2019 and will not review state plans until their rules are in place.
