If you’re a resident or a property owner in the Town of Jackson, you’ve probably been following the evolving conversation around Short-Term Rentals (STRs). After extensive community input and deliberation, the Town Council has rolled out new rules that will reshape how STRs operate starting January 1, 2024. Here’s what you need to know.
What’s Changing?
The Town defines an STR as the rental of a housing unit for less than 30 days. Under the new rules, homes in residential zones outside of the Town Lodging Overlay and Resort District can now be rented on a short-term basis. But there’s a catch: you’ll need to apply for an annual Basic Use Permit (BUP) and a Business License.
Key Rules to Keep in Mind
- Rental Limitations: Each housing unit can be rented out as an STR only three times each calendar year.
- Duration Cap: You can rent out your property for a maximum of 60 days per year.
- Neighborhood Notification: Homeowners must inform their neighbors annually about their intent to rent out their property.
- HOA Approval: If you’re part of a Homeowners Association, you’ll need their approval for your STR to be in compliance with Town rules.
- Strict Penalties for Non-Compliance: Violating these rules could lead to a five-year prohibition from operating an STR.
Why the Change?
The Town of Jackson received numerous complaints related to STRs under the previous system, citing issues like noise, parking, and a loss of community character. The old rules were challenging to enforce and often left both residents and the Town in a bind. The new regulations are designed to be clearer, more enforceable, and more considerate of residential neighborhoods.
What About STRs in the Lodging Overlay and Resort District?
If your property falls within these areas, the new program doesn’t change much for you, other than simplifying the application process.
How to Apply
All applications for STRs in residential zones must go through the Town’s new SmartGov web-based portal system. It’s a good idea to start familiarizing yourself with this system now, as applications can already be submitted in preparation for the program’s launch in 2024.
