The Wyoming Supreme Court Tuesday overturned a district court opinion and ruled that Jackson Hole Airport must comply with the Wyoming Public Records Act. The court stated that under Wyoming statutes, the Board is both an airport board and a joint powers board. The Board had believed that the Special District Public Records and Meetings Act governed the scope of documents required to be produced to the public rather than the broader Wyoming Public Records Act. The question came into play in a lawsuit a lawsuit filed by Wyoming Jet Center LLC, asserting that the Board did not produce a detailed listing of documents which were withheld because they were privileged or contained third parties’ confidential financial information, and Wyoming Jet Center LLC maintained that such a detailed listing was required under the Wyoming Public Records Act. The Supreme Court agreed stating a portion of the Special District Act cites that whenever it and the broader Wyoming Public Records Act conflict, the broader act takes precedence. Airport Director Jim Elwood welcomed the ruling, adding “The Airport Board is pleased to finally have this determination as to which public records statute applies to the Board.”
