A bill has been introduced in the Wyoming legislature that would prohibit cities and towns from forcing landowners to agree to deed restrictions in order to connect to public infrastructure.
If passed, Senate File 157 would also not allow local governments to base a zoning decision on whether or not the landowner had a connection agreement to hook up to public water and sewer systems.
Some local officials have said they could deny the sewer connection to the proposed North South Park development unless it saw the certain benefits to the community.
In a December 7th, 2020 letter sent by the Jackson Town Council to the Teton County Commission declared that approval to connect to all Town infrastructure is at the sole discretion of the Jackson Town Council regardless of whether capacity is available or not.
The bill states that, “No city or town shall condition the provision of any public improvement under subsection on the inclusion of deed restrictions or other restrictions which limit the value of a property or properties.”
