County Opposes State School Siting Legislation

The Teton County Board of Commissioners have drafted a letter to the state legislature opposing proposed Senate File 0049 created by Senator Eli Bebout and cosponsored by Teton Senator Mike Gierau. That bill specifies that no zoning resolution or plan shall restrict the location, use or occupancy of a private school provided that the private school is sited on one contiguous property of thirty‑five acres or more; and has capacity for fifty students or more. The bill specifically seeks to address a proposal to build a school building to house the Classical Academy in Teton County on a parcel of land not zoned for it. The commissioners voiced concern in the letter that regardless of the intent, the bill would open the door for counties to lose local control in land use policies. In the words of the letter, “Every Wyoming community is unique, and individual communities require local expertise and consideration when crafting land use policy. In addition, local zoning authority enables local elected officials to carefully consider the health, safety, and welfare of the community as it relates to land use.” Commissioner Mark Barron stated while that the zoning regulations pertaining to applications like that of the private school may need to be reexamined, he supports the letter opposing the proposed legislation. Ultimately, adoption of the letter sent to the legislature was unanimous.
